Every constitution has two halves: the rights that protect us from harm, and the rights that grant us access to good. Earth has never had one. This is one: complete, evidenced, open, every claim on the record. here, the usual order of the web is reversed: machines sign the wire. humans sign paper. the margin will open later, stewarded, not managed. until then this is one author’s draft of a commons, and it says so.
We, the undersigned inhabitants of Earth, born under flags we did not choose, into debts we did not sign, and beliefs we did not pick, hold that freedom has two faces: freedom from what harms us, and free access to what sustains us.
No border grants these freedoms, and no border may deny them. We do not ask permission to draft this Charter. We publish it, we evidence it, we sign it, one article at a time, until it is no longer a draft.
the commons is not open access. a commons has keepers, rules, and memory. stewardship is not ownership. to care for a thing is not to own it, and never was. “belongs to no one” is not terra nullius. land declared nobody’s has too often meant land taken; where sovereignty and custodianship already exist, indigenous, communal or inherited, this charter reads “unowned” as “already cared for”. public infrastructure is not ownerless. it is owned by everyone, which is the opposite. free culture is not free labor. what is shared willingly must not become work taken by force.

001 · FREE FROM TAXING HUMAN LABOR
No human being shall be taxed for the act of working. Public revenue shall be drawn first from harm, rent, and privilege, and last from labor.
002 · FREE FROM CRIME
Every person has the right to live unafraid. Public safety budgets shall fund prevention before punishment, and every intervention shall carry its evidence with it.

003 · FREE EDUCATION
Knowledge, once created, belongs to everyone. No fee shall stand between a human being and the recorded knowledge of the species.
004 · FREE MOBILITY
Movement within one's city is a right, not a purchase. Public transit shall be funded as public space, open to all, gated for none.

005 · FREE FROM IMPOSED BELIEF
No power shall compel a human being into belief or out of it. The state shall have no religion, and no religion shall have the state.
006 · FREE FROM THE ATTENTION RACKET
No system shall be engineered to capture human attention against human intention.

No one may profit from putting poison into a body or a biosphere that did not consent.
008 · FREE FROM SURVEILLANCE
Every person owns the record of their own life. Watching everyone to find anyone is forbidden.
009 · FREE FROM CORRUPTION
Public power is a trust. Whoever converts it to private gain steals from everyone at once.

010 · FREE ACCESS TO TECHNOLOGY
Every human being has the right to connect, to compute, and to repair. The tools of the age belong to the age.
011 · FREE HEALTH
No one shall be priced out of staying alive. Prevention and primary care shall be free at the point of need.
012 · FREE ENERGY
Energy is the master resource. A basic share of clean energy shall be every person's birthright.
013 · FREE WATER
Water is the precondition of every right. The first measure of it shall be free to every person, everywhere.
014 · FREE TIME
The purpose of progress is time. Productivity gains shall be paid out in hours as well as money.

015 · THE EVIDENCE RULE
No article of this Charter shall claim what it cannot show. Every claim carries its evidence in the open Ledger, and no article is adopted without a working precedent somewhere on Earth.
016 · THE OBJECTION RULE
Every article shall state the strongest argument against itself, fairly and in full. An article that cannot survive its own objection shall be amended or withdrawn.
017 · THE AMENDMENT
Nothing here is final. Any article may be amended in public when shown to be wrong, and every version remains on the record.
018 · THE SIGNATORIES
This Charter binds no one and invites everyone. Its only force is the number and the names of those who sign. Earth is the constituency.

War is a failure of politics, not an instrument of it. No person shall be conscripted into killing, and aggression shall be the crime of leaders, never of peoples.
020 · FREE FROM SLAVERY & DEBT BONDAGE
No human being may be owned, indebted into servitude, or worked without exit. Whoever profits along a chain of forced labor answers for the whole chain.
021 · FREE FROM DISCRIMINATION
No door shall be closed to a human being for what they are rather than what they do.
022 · FREE FROM CENSORSHIP & PROPAGANDA
No power shall decide for a human being what they may know, say, or read.
023 · FREE FROM MONOPOLY
A market captured is a government unelected. No private power shall grow beyond challenge.
024 · FREE FROM BUREAUCRACY
The state exists to serve, not to be petitioned. No right shall depend on a form the citizen must first discover.
025 · FREE FROM HUNGER
No human being shall go hungry on a planet that grows food enough for all. Famine is not weather; it is policy, and it shall be prosecuted as such.
026 · FREE FROM ENGINEERED ADDICTION
No business model shall be built on breaking a human being's control over their own appetites.

Housing is the precondition of a private life. No one shall be left unsheltered, and homes shall be for living in before they are for investing in.
028 · FREE EXPRESSION & ASSEMBLY
Every person may speak, publish, and gather. The answer to speech is speech, and the street belongs to those who assemble in peace.
029 · FREE JUSTICE
A right you cannot afford to enforce is not a right. Justice shall be reachable by every person, in time to matter.
030 · FREE IDENTITY
Every human being shall be counted, named on their own terms, and able to prove who they are, for free.
031 · FREE NATURE
Every person has the right to reach living nature, and living nature has standing of its own.
032 · FREE CARE
Care is work. No one shall be impoverished by raising the young or tending the old.
033 · FREE MOVEMENT ACROSS BORDERS
No human being is illegal. Movement across borders shall be safe and orderly, opened by evidence rather than closed by fear.
034 · FREE DEATH
A life that belongs to you includes its end. No one shall be forced to die in pain, and no one shall decide your death but you.

035 · THE COLLISION RULE
When articles collide, neither wins by rank. The resolution shall do the least damage to both, and it shall be written down.
036 · THE COMMONS
This Charter belongs to no one and answers to everyone. All may read and annotate; invited stewards may amend; every hand that edits signs its name.
